Terms of Use
These Terms govern access to pcc-clubos.com, PCC ClubOS and related services operated by Padel Club Collective (“PCC”, “we”, “us” or “our”). By using the service, creating an account, registering or participating, you agree to these Terms and applicable PCC competition rules. If you do not agree, do not use the service.
2.1 Eligibility and age requirement
You must be at least 18 years old to create an account, register, participate or use ClubOS. By using the service, you confirm that you are at least 18 and legally able to agree to these Terms. PCC may request reasonable evidence of age and may refuse or cancel access where the age requirement is not met.
2.2 Accounts and authorised users
You must provide accurate, current information and keep login credentials confidential. You are responsible for activity through your account unless caused by PCC’s failure to use reasonable security. Notify us promptly of suspected unauthorised access. Club administrators may access and manage information only for authorised club and competition purposes and must not misuse, export or disclose it.
2.3 Competition administration
PCC may publish and apply competition rules covering eligibility, divisions, scheduling, scoring, rankings, appearances, reserves, withdrawals, qualification, conduct, corrections and disciplinary matters. Official records in ClubOS, as corrected through an authorised process, will be used for competition administration. PCC may correct clear errors, investigate irregularities and make reasonable operational decisions to preserve safety, fairness and continuity.
Fixtures, venues, formats and schedules may change due to availability, weather, safety, technical issues or circumstances outside reasonable control. PCC will try to provide reasonable notice but does not guarantee that every fixture or event will proceed as originally scheduled.
2.4 Fees, cancellations and refunds
Any applicable fee, court cost, cancellation rule and refund position will be shown at registration or in the relevant competition information. Unless expressly stated otherwise, fees payable to clubs or venues are governed by those parties’ terms. Nothing in these Terms removes rights that cannot lawfully be excluded under applicable consumer law.
2.5 Acceptable use and conduct
You must not:
· submit false registrations, scores, age confirmations or eligibility information;
· manipulate rankings, results, availability or any official competition record;
· access another person’s account or data without authorisation;
· scrape, copy, reverse engineer, disrupt, overload or probe the service except where law expressly permits;
· upload malicious code or use the service for unlawful, fraudulent, abusive, threatening or discriminatory activity;
· infringe privacy, confidentiality, intellectual property or other rights; or
· harass players, officials, club staff or other users.
PCC may investigate suspected breaches and may correct records, restrict functions, suspend or terminate access, disqualify participation or refer serious matters to a club or relevant authority. Decisions will be proportionate and may be reviewed under any published PCC appeal process.
2.6 User content, results and media
You retain ownership of original content you submit. You grant PCC a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display that content only as reasonably necessary to operate, secure, promote and document PCC services and competitions. You confirm that you have the right to provide it.
Official competition facts, including fixtures, scores and rankings, may be recorded and published. Event photography or promotional media involving an identifiable person will be handled in accordance with the Privacy Policy, notices at the event and any consent required by law. A separate media-consent choice should be provided where appropriate.
2.7 PCC intellectual property
PCC and its licensors own the service, software, designs, branding, databases, documentation and other protected materials, excluding user content and third-party materials. No ownership rights are transferred. You may use the service only for its intended personal or authorised club-administration purpose.
2.8 Third-party services and clubs
Clubs, venues, payment providers and linked services may operate independently and apply their own rules and terms. PCC is not responsible for independent acts, omissions, facilities, products or services of third parties, except to the extent liability cannot lawfully be excluded.
2.9 Service availability and disclaimers
We aim to provide a reliable service but do not promise uninterrupted or error-free access. The service may be changed, maintained, suspended or withdrawn. To the maximum extent permitted by law, the service is provided on an “as available” basis without implied warranties that may lawfully be excluded. PCC does not provide medical advice; participation in sport carries inherent risks, and players should assess their fitness and follow venue safety requirements.
2.10 Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct or other protected rights. To the maximum extent permitted by law, PCC will not be liable for indirect, incidental, special or consequential loss, loss of profit, loss of opportunity or loss of data arising from use of the service. Where liability may lawfully be limited, PCC’s aggregate liability relating to a paid service will not exceed the amount paid directly to PCC by the affected user for that service during the twelve months preceding the event giving rise to the claim. For a free service, liability will be limited to the minimum amount permitted by law.
2.11 Suspension and termination
You may stop using the service and request account closure, subject to retention of records required for law, security, disputes or competition integrity. PCC may suspend or terminate access where reasonably necessary for a breach, safety, security, non-payment, legal compliance, misuse or discontinuation of the service. Provisions intended to survive termination—including intellectual property, liability, dispute and retained-record provisions—will continue to apply.
2.12 Changes, governing law and contact
We may update these Terms to reflect service, operational or legal changes. Material changes will be posted with a new effective date and notified where appropriate. These Terms are governed by the laws of the Republic of Indonesia. The parties should first attempt in good faith to resolve disputes by contacting admin@pcc-clubos.com. If unresolved, disputes will be submitted to the competent courts of Indonesia, without limiting any mandatory consumer right to use another forum or remedy.
